Health Answers by Pfizer is a chatbot tool that uses Generative AI to summarize trusted sources, including publicly and legally available peer-reviewed scientific literature, in combination with other content such as text, graphics, images, audio, video, compilations, and other materials generated by Generative AI or from Pfizer's licensors (collectively, "Content"). Generative AI is an experimental technology that is not human, which can display biases and can make mistakes. Like all Generative AI content, the Content here is probabilistic in nature and may be inaccurate due to the nature of the technology or cited content. While Health Answers by Pfizer can be a helpful starting point for learning about common issues, users should verify the accuracy of the Content with their medical professionals.

You agree that Health Answers by Pfizer is for informational purposes only and is not, and cannot substitute for, professional medical guidance. You understand that Content generated by the chatbot tool is drawn from third-party sources and does not reflect the opinions or statements of Pfizer Inc., or any of its employees, and by using Health Answers by Pfizer you agree not to assert otherwise.

Pfizer will use reasonable efforts to include accurate and up-to-date information on these Services but makes no warranties or representations of any kind as to its accuracy, currentness or completeness. Both personalized and non-personalized Content is current as of its listed published date and in some cases, Content may no longer appear in your “Saved Asset Library”. Changes you make to your “Health Information Profile” may impact your personalized Content and previous Content may no longer appear in your “Saved Asset Library”.

Images used on Health Answers by Pfizer may be licensed stock photography that features model(s). Any person depicted in a stock image is a model, the models have no affiliation with Health Answers by Pfizer and the image, including the depiction of the model, is being used for illustrative purposes only. Some Content may contain AI-generated avatars, and these avatars are digital depictions of humans, but are not real people.

While Health Answers by Pfizer is designed to provide access to health and wellness information and actions, Pfizer is not a medical provider and does not purport to offer medical advice, diagnosis, prevention, monitoring, or treatment of a disease or injury through the Services (including the Content) or otherwise. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on these Services.

It is your responsibility to present your medical data to your physician or other health care provider for proper analysis and diagnosis. You agree that neither Pfizer nor any other party is or will be liable or otherwise responsible for any decision made or any action taken or not taken due to your use of information presented through these Services. Any reliance on or use of the Content on the Services is at your own risk.

By using this tool, you acknowledge and agree that any information you provide may be used for safety reporting and pharmacovigilance purposes. This includes the collection, analysis, and reporting of any adverse events or other safety-related information shared. Health Answers by Pfizer is not a method for providing notice to Pfizer and is not monitored for that purpose.

Pfizer respects your privacy. Please read the applicable Privacy Notice carefully for details about how we collect, use, store, process, transfer, and disclose your personal information. The applicable Privacy Notice is incorporated by this reference into these Terms and Conditions. Pfizer believes that any risks associated with using Health Answers by Pfizer would be minimal. As with all uses of the Internet, there is some risk to your personal information and the security of your devices. While Pfizer vets its action partner affiliates, Pfizer cannot guarantee the privacy or security of information you may share over the Internet.

Health Answers by Pfizer allows you to record and store information after you create an account. You agree that you will provide Pfizer with accurate, truthful, and current registration information and that you will maintain and update such information regularly.

You are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your Health Answers by Pfizer passwords or accounts. You agree to notify Pfizer immediately in the event you believe your account or password has been compromised. To do so, please visit our Contact Us page. You grant Pfizer and all other persons or entities involved in the operation of the Services the right to transmit, monitor, retrieve, store, and use your information in connection with the operation of the Services. Pfizer cannot and does not assume any responsibility or liability for any information you submit, or your or third parties' use or misuse of information transmitted or received using Health Answers by Pfizer tools and services.

The Linked Sites are not under the control of Pfizer.

Pfizer participates in affiliate marketing, which means that if you click these links you will leave our Site and Pfizer may receive compensation. The affiliate products and services that are featured are automatically generated based on certain keywords. If you purchase any of the products or services offered by these third parties, you are purchasing directly from those third parties or if the Services is a marketplace, from sellers on the marketplace, and not from Pfizer.

You are prohibited from using these Services to attempt to “break it” or “trick it” in disregard of safeguards or other features or messages aimed to protect the public. Content generated by Health Answers by Pfizer is for personal individual use only for informational purposes and cannot be used for other purposes, such as publication, use in proceedings, or attribution to Pfizer.

If you violate any of these Terms and Conditions, including the “Compliance of Laws” and “Inappropriate Use/Hacking” sections, your permission to use the Services and Content automatically terminates and you must immediately destroy any copies you have made of any portion of the Content.  Nothing contained herein shall be construed as conferring by implication, estoppel or otherwise any license or right under any patent or trademark of Pfizer, or any third party. Pfizer may terminate these Services and may remove any public or shared links, and any other Site Content, for any reason at any time, with or without notice.

Pfizer has no obligation to provide you with any updates, new versions, enhancements, error corrections, or any other modification of these Services, but if Pfizer does so, in its sole and absolute discretion, any such modification shall be subject to the terms of these Terms and Conditions. For answers that are considered “unverified” because the Services did not have enough Content from the trusted sources to generate a verified answer using Health Answers by Pfizer’s standards, the Content may include an AI-generated unverified answer using OpenAI GPT-4o mini or GPT-4o. This unverified answer may include information from the open Internet, available before October 2023, and therefore, may be out of date, inaccurate, or potentially harmful. You agree to indemnify, defend, and hold harmless Pfizer, its officers, directors, employees, agents, suppliers, and third-party partners from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation by you of these Terms and Conditions and/or any intentional wrongdoing by you.

You agree that access to and use of these Services and its Content thereof is at your own risk. Pfizer disclaims all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. Neither Pfizer nor any party involved in creating, producing, or delivering these Services shall be liable for any damages, including without limitation, direct, incidental, consequential, indirect, or punitive damages, arising out of access to, use of or inability to use these Services, or any errors or omissions in the Content thereof. This limitation includes damage to, or for any viruses that infect, your computer equipment.

Subject to any applicable terms and conditions set forth in our Privacy Notice, any communication or other material that you send to us through the Internet or post on the Services by electronic mail or otherwise, such as any questions, comments, suggestions or the like, is and will be deemed to be non-confidential and Pfizer shall have no obligation of any kind with respect to such information. Pfizer shall be free to use any ideas, concepts, know-how or techniques contained in such communication for any purpose whatsoever, including but not limited to, developing, manufacturing, and marketing products.

These Services and its Contents are intended to comply with the laws and regulations in the United States of America (“U.S.”) and they are directed to and is intended for use only by residents of the U.S. and may not be suitable outside of the U.S. Other countries may have laws, regulatory requirements and medical practices that differ from those in the U.S. If you access these Services from outside the U.S., you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. Any offer for any product or service made on these Services is void where prohibited.

EACH PARTY, TO THE EXTENT PERMITTED BY LAW, KNOWINGLY, VOLUNTARILY AND INTENTIONALLY, AND FREE FROM DURESS OR COERCION, WAIVES ITS RIGHT TO A TRIAL BY JURY OR JUDGE IN ANY ACTION OR LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS AND THE TRANSACTIONS IT CONTEMPLATES. EACH PARTY ACKNOWLEDGES THAT IT HAS RECEIVED THE ADVICE OF COMPETENT COUNSEL. EACH PARTY CHOOSES TO RESOLVE ANY CLAIMS OR DISPUTES THROUGH ARBITRATION.

These Terms and Conditions and your use of these Services shall be governed by the laws of the U.S. and the State of New York without regard to its conflicts of laws principles.

Any dispute, controversy, or claim arising out of, relating to, or in connection with this Agreement, including with respect to the formation, applicability, breach, termination, validity or enforceability thereof, shall be finally resolved by arbitration. The arbitration shall be conducted by three arbitrators, in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”); the claimant shall nominate an arbitrator in its request for arbitration. The respondent shall nominate an arbitrator within 30 days of the receipt of the request for arbitration. The two arbitrators nominated by the parties shall nominate a third arbitrator within 30 days after the nomination of the later-nominated arbitrator. The third arbitrator shall act as chair of the tribunal. If any of the three arbitrators are not nominated within the time prescribed above, then the AAA shall appoint the arbitrator(s).

The seat of the arbitration shall be New York, New York, United States, and it shall be conducted in the English language. The costs of the arbitration, including the parties’ reasonable legal fees, shall in principle be borne by the unsuccessful party or parties. However, the arbitral tribunal may apportion such costs between the parties if it determines that apportionment is reasonable, taking into account the circumstances of the case. The arbitration award shall be final and binding on the parties, and the parties undertake to carry out any award without delay. Judgment upon the award may be entered by any court having jurisdiction of the award or having jurisdiction over the relevant party or its assets. This arbitration clause is governed by and shall be interpreted in accordance with the law of the State of New York.

The parties agree that the arbitration shall be kept confidential. The existence of the arbitration, any non-public information provided in the arbitration, and any submissions, orders or awards made in the arbitration (together, the “Confidential Information”) shall not be disclosed to any non-party except the tribunal, the AAA, the parties, their counsel, experts, witnesses, accountants and auditors, insurers and reinsurers, and any other person necessary to the conduct of the arbitration. Notwithstanding the foregoing, a party may disclose Confidential Information to the extent that disclosure may be required to fulfil a legal duty, protect or pursue a legal right, or enforce or challenge an award in bona fide legal proceedings. This confidentiality provision survives termination of the Agreement and of any arbitration brought pursuant to the Agreement.

If any provision of these Terms and Conditions is held to be unlawful, void, or unenforceable, then such provision shall be severable without affecting the enforceability of all remaining provisions.

You acknowledge and agree that Services are not intended to provide, and do not constitute, any medical, financial, investment, regulatory, professional, or other advice, recommendations, or guidance. The Services may contain forward-looking statements that reflect our current expectation regarding future events, financial and operating performance, business plans and prospects, current or prospective products or services. Any such forward-looking statements involve substantial risks and uncertainties. Actual developments or results could differ materially from those projected. We assume no obligation to update any forward-looking statements as a result of new information or future events or developments.
